Terms of Use

1. Acceptance and eligibility

By creating an account or using Seekho365 ("the service", "we", "us"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the service. Accounts are created only by a parent or legal guardian, who confirms they are at least 18 years old and have full authority to accept these terms and to consent on behalf of the child whose learner profile they create.

2. What Seekho365 is

Seekho365 is a practice and revision tool for CBSE Class 9. It supports learning through active practice and is a supplement to school teaching and textbooks, not a replacement for them.

3. AI-generated content and accuracy

Many questions, answers, and explanations are generated with the help of artificial intelligence and then curated. Despite our checks, this content may contain mistakes, outdated information, or inaccuracies, including wrong answer keys or explanations.

Treat all material as practice, not as an authoritative source. Verify anything important against your official CBSE textbooks and your teacher. If you spot an error, please use the in-app "report" option. We do not warrant that the content is complete, correct, current, or suitable for any particular exam, and we are not responsible for any consequence of relying on it.

4. No guarantee of results

Seekho365 is a study aid. We do not promise any specific marks, grades, ranks, or exam outcomes. Progress depends on many factors outside our control.

5. Not affiliated with CBSE or any board

Seekho365 is independent. We reference the CBSE curriculum only to align our practice with what students study. We are not affiliated with, endorsed, sponsored, or certified by CBSE, NCERT, or any board or school, and all trademarks belong to their respective owners.

6. Accounts, PINs, and acceptable use

• The parent or guardian is responsible for the account and for all activity under it, including each child's use.
• Keep your password and each child's PIN confidential. Tell us promptly of any unauthorised use.
• Use the service only for personal, non-commercial study. Do not misuse it, attempt to disrupt, overload, reverse engineer, scrape, or gain unauthorised access to it, and do not copy, resell, or redistribute its content.
• You are responsible for the accuracy of the information you enter and for keeping it appropriate.

7. Intellectual property and feedback

The service, its design, and its content (other than third-party or curriculum material) belong to Seekho365 and are protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the service for study. Any feedback, error reports, or suggestions you send us may be used by us without restriction or obligation to you.

8. Third-party services

The service relies on third parties such as AI providers, hosting, and email delivery. We are not responsible for their acts, omissions, outages, or content, and their availability is outside our control.

9. Availability and "as is" service

The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We may update, change, limit, or suspend any part of the service at any time and do not guarantee uninterrupted or error-free access.

10. Limitation of liability

To the maximum extent permitted by law, Seekho365 and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of marks, results, data, goodwill, or opportunity, arising from your use of or inability to use the service, or from reliance on any content (including AI-generated material). To the extent liability cannot be excluded, our total aggregate liability to you is limited to the amount you paid us for the service in the twelve months before the claim, or if the service was free, to one thousand Indian Rupees (INR 1,000). Nothing in these terms limits any liability that cannot be limited under applicable law.

11. Payments and subscriptions

Seekho365 is free to try for 7 days. After the trial, continued practice for each child requires a paid subscription of ₹365 per child for one year. This is an inaugural price that we may change for future purchases. Payments are collected by our payment provider; we do not store your card details. The subscription is a one-time annual charge and does not auto-renew, so you will not be charged again unless you choose to renew. Fees are inclusive of applicable taxes unless stated otherwise, and the price for a period you have already paid for will not change during that period. Access is tied to a learner profile and is personal and non-transferable. Refunds and cancellations are governed by our Refund and Cancellation Policy.

12. Indemnity

You agree to indemnify and hold harmless Seekho365 and the people behind it from any claims, losses, or costs (including reasonable legal fees) arising from your misuse of the service, your breach of these terms, or your violation of any law or the rights of another.

13. Suspension and termination

We may suspend or terminate access, or remove content, at our discretion, including where we reasonably believe these terms have been breached or to protect the service or others. You may stop using the service and delete your account at any time. Sections that by their nature should survive termination (including sections 3, 7, 10, 11, 12, and 15) will continue to apply.

14. Changes to the service and these terms

We may update these terms from time to time. If we make material changes we will update the version above and, where appropriate, ask for fresh agreement. Continued use after a change means you accept the updated terms.

15. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to any mandatory consumer protections, the courts of Kolkata, India will have exclusive jurisdiction over any dispute arising from these terms or the service.

16. General

If any provision of these terms is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours to a successor. These terms and the Privacy Policy are the entire agreement between you and us about the service.
